(Night Shift Couture), the security of your personal data is our priority, and as the Data Controller, we would like to inform you about the processing of your personal data in accordance with the Personal Data Protection Law No. 6698 (KVKK) and within the framework of our disclosure obligation.

The Data Controller, as defined by KVKK, is VOLSUZI HAZIR GİYİM SAN. TİC. A.Ş., registered with the Istanbul Trade Registry under registration number 184224-5, with MERSIS number 09250842927, and headquartered at Teşvikiye Mahallesi, Teşvikiye Caddesi, No: 28/2 Şişli/İstanbul.

1. Your Personal Data, Collection Method, Processing Purposes, and Legal Basis

Your personal information is collected through your visits and purchases at Night Shift Couture stores or our website, your e-newsletter subscription, your shares in e-mail correspondence, and memberships established by signing the website membership agreement. In the event that you purchase goods or services from Night Shift Couture or otherwise enter into a commercial or legal relationship with VOLSUZI HAZIR GİYİM SAN. TİC. A.Ş., your personal data, including identity data (name, surname), contact data (e-mail address, address, and phone information), data related to the product you purchased, and, in case you call our company to submit a request or complaint, your auditory data are collected electronically directly from you by VOLSUZI HAZIR GİYİM SAN. TİC. A.Ş. This personal data is processed under Article 5(2) of the Law on the legal grounds of the establishment/performance of the sales contract or membership agreement and the establishment of membership rights. Gender information is processed under the scope of mandatory legitimate interests without prejudice to your rights.

Additionally, your date of birth information and, upon request, your special preferences regarding any product may be processed based on your explicit consent, with the necessary precautions taken to protect their confidentiality. This is done so that you can benefit from the products and services offered by our company VOLSUZI HAZIR GİYİM SAN. TİC. A.Ş. without any problems, to improve our product and service diversity since our philosophy is to be the best product in the market and have a customer-oriented approach, and to provide services with the principle of "best service, best product" for you. 1. Explicit Consent in the Processing of Personal Data

If there is no previously obtained consent or permission from you, we will request your consent for your personal data that does not fall under the above-mentioned and one of the lawful processing grounds in Article 5/2 of the law, as required by legal obligation, and we will request your permission to send you commercial electronic messages. If you find the information text presented for your attention in the membership area and other personal data entry areas on our website or mobile application acceptable, you can simply check the relevant box and click the SAVE button for your personal data that requires explicit consent, as explained in this text. With the same method and another permission checkbox area, you will also be able to give your commercial electronic communication permissions. 1. Sharing and Transfer of Data

We never share your personal data outside the framework drawn by the Law. Your personal data may be shared, subject to adequate and effective measures being taken in accordance with the security and confidentiality principles specified in the legislation, with public institutions or organizations authorized to request this data due to legal obligations, our business partners and suppliers with whom we have agreements due to our activities and from whom we receive services to provide you with products and services (such as cargo companies for delivering products to you, call centers for communication activities).

1. Your Rights Under the Law

As data subjects, you have the right to submit your requests regarding your personal data based on your rights under the Law, in accordance with the procedures and principles specified in the Data Subject Application Procedures Communiqué announced by the Personal Data Protection Authority, by filling out the Application Form published on the same website or by sending a similar written document or email to our postal address or to the email address info@vibeismagic.com, which you have previously provided to our company and is registered in our system, in a way that your identity can be verified, or by sending it to VOLSUZİ HAZIR GİYİM SAN. TİC. A.Ş. through the registered electronic mail (KEP) address, signed with a secure electronic signature or mobile signature. VOLSUZİ HAZIR GİYİM SAN. TİC. A.Ş. will finalize the request free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, the fee specified in the tariff determined by the Personal Data Protection Board will be charged by VOLSUZİ HAZIR GİYİM SAN. TİC. A.Ş. 

 

In this context, you have the right to:

• Learn whether personal data is being processed,

• Request information if personal data has been processed,

• Learn the purpose of processing personal data and whether they are used appropriately for their purpose,

• Know the third parties to whom personal data is transferred in the country or abroad,

• Request the correction of personal data if it is incomplete or incorrectly processed, and request notification of this process to third parties to whom the personal data has been transferred,

• Request the deletion or destruction of personal data if the reasons requiring its processing cease to exist, even though it has been processed in accordance with the Law No. 6698 and other relevant law provisions, and request notification of this process to third parties to whom the personal data has been transferred,

• Object to a result produced against you by analyzing the processed data solely through automated systems,

• Request compensation for damages in case of loss due to unlawful processing of personal data.
